The Okada Judicial Division of the High Court of Nigeria, Edo State presided over by Justice A.T. Momodu has restrained the Odionwere of Ugbineh Community, Pa Usiobaio Osayande, Gabriel Usiobaifo, Uhunoma Omoruyi and Omobude Agho, who are defendants or respondents, their servants, privies, agents and supporters from employing violence, making threat calls or sending threat voice notes and/or destroying or damaging houses on the private business premises or any of the claimants or other persons in Ugbineh community pending the hearing and determination of the motion for interlocutory injunction sought by the claimants or applicants.
Justice Momodu gave the ruling while granting an order of injunction upon the Motion Exparte filed by Pa Gaius Osaremwinda, Ozukpogieva of Ugbineh community, Pa Oseye Eriamiantoe, Ozukpogieha, Pa Akwete Asemota, Ozokogiene, Chief Priest Alfred Agbonedeso, Second Ohen Ovia, Ugbineh community and Dominic Edo, Okaighele of Ugbineh community who are the claimants or applicants.
The order of interim injunction also restrains the defendants/respondents from further driving into Ugbinedh community in convoy or cars, shooting into the air indiscriminately to threatened and intimidate residents of Ugbineh community or engage in any conduct capable of disrupting the normal day to day life of Ugbineh community pending the hearing and determination of the notice for interlocutory injunction.
The court ordered that the order be served along with the originating processes on the defendant/respondents and adjourned to Nineteenth June, 2024 for hearing of the motion on notice for interlocutory injunction.
