
The Edo State High Court, Okada Judicial Division presided over by Justice Edoghogho Eboigbe has granted an order of interim injunction restraining the Odionwere, Pa Okina Igbinovia Okoro, Third In Command otherwise known as Ozokpogieha, Pa Frank Odigie, Osagie Ederaho, Stephen Ilekhue, Osasere Imejebi, Osaro Edward Agege, Osarobo Joseph Okina all of Emah community in Ovia North East Local Government Area of Edo, who are defendants or respondents in a suit filed before the court.
The defendants are restrained from further selling, transferring, alienating or disposing of any community interest in individual farm lands within Emah Village under the guise of overriding community interest without first complying with Benin Native law and order of consultation with the community and individual farm owners, pending the hearing and determination of the interluctory injunction filed with the applications.
Also restrained by the court are the Defendants or respondents’ agents, servants, privies or anyone connected with the defendants or respondents.
The court granted the interlocutory injunction having heard from I.E. Orhue Esquire, Counsel to the claimants/applicants in the absence of the parties.
This restraining order was sought after by claimants or applicants, Pa Augustine Igbinovia, Okoro, the ozukpogieva or second in command, Pa Cole Sam Agege, Fourth in command, Pa Stephen Gauis Obaseki, Pa Sunnyson Enoma Nosakhare and six others for themselves and on behalf of members and people of Emah village except the defendants.
